This book offers an insight into the interpretation of Art. 3 ECHR in the jurisprudence of the European Court of Human Rights. Over the last few decades, the court has considerably widened the scope of Art. 3 ECHR to include a series of new cases, such as non-refoulement cases. Pilot rulings on the prohibition of torture and the establishment of procedural regulations regarding Art. 3 cases further show how the court has simultaneously extended the reach of its jurisdiction. The author poses and discusses the question of to what extent these developments encroach on the contracting parties'sovereignty and, extending beyond that, whether such infringements could potentially be justified by the court's primary responsibility to protect and ensure human dignity.
